1. Online Order
Using the present website, the CUSTOMER can, following simple and clear steps, place an order and complete the process of the distance online purchase of Niris’ products. To place an order, the CUSTOMER has to choose the products to buy following the detailed and clearly explained process, which is included in our website. The CUSTOMER can complete the purchase either as a guest or as a REGISTERED CUSTOMER/MEMBER.

2. CUSTOMER Notice
Before placing an order, the CUSTOMER should be informed in detail about the essential information and terms of the purchase contract, which are always provided for the CUSTOMER’s information in a respective field before completing the order.

3. Legal framework of online shopping
The purchase of products via the present online shop is governed, simultaneously and in parallel, by the provisions included in chapter PURCHASE TERMS, by the Terms of Use of the website in whole as well as by the applicable legislation.
The CUSTOMER confirms that, before proceeding to the order, they have read all terms and accepted their content.

4. Product characteristics
The basic product characteristics are indicated in this website under the relevant field in each case. It is likely that, due to technical reasons concerning the website, the browser or accessing the website via a mobile device, a partial discrepancy can be noticed between the shown product against the original, such as differences in the colors of the product. Νiris is not responsible for any such discrepancies.

5. Order process
To place an order, you need to follow the following steps:
Choose a section within the website and then the type of product.
See the product(s) you are interested in. Under the description section you can find useful information, such as the composition, reference code, price and size.
Choose a product, the quantity —provided the chosen product is available in more colors/prints—and add it to the cart. Then, you can choose if you wish to continue shopping or complete the order.
If you wish to continue shopping, repeat the above process. Otherwise, if you wish to complete the order, you can continue by creating an online account or by proceeding with the quick buy option without registering.
Choose the payment method: Credit/Debit card, Paypal or Bank transfer to our account.
Read the order confirmation carefully.
Before completing the order, the CUSTOMER can cancel or alter the information of the order (quantity or product). In any case, Niris suggests the CUSTOMER to check the order information in detail before selecting the payment button.
If the CUSTOMER proceeds with the order, they will immediately receive the order confirmation via email in the address provided, which will confirm that the order has been received by Niris. It is noted that the receipt of the order on behalf of the CUSTOMER does not signify that the order has been accepted by Niris nor that the contract of purchase for the product(s) has been concluded.
A confirmation email will be then sent to the CUSTOMER informing them that the order has been sent and that the request to buy the product has been received. In case a product has been bought, the aforementioned confirmation will include the reference number of the parcel operator, so that the CUSTOMER can track the ordered products and the progress of the shipment. After completing the payment, receiving the second email by Niris signifies that the contract of purchase has been concluded for the product(s) included in the order placed. In case an amount that doesn’t refer to the products included in the order has been paid or in case the CUSTOMER hasn’t received a second confirmation email, the amount in question will be refunded to the CUSTOMER.

6. Correctness of CUSTOMER data.
All data indicated by the CUSTOMER while placing the order must be true and accurate. To avoid any mistakes, it is suggested that the CUSTOMER checks all data provided before completing the order.

7. Prices – stock
The prices of the products can be modified. Niris notes that all prices included in the website are subject to changes which the CUSTOMER will be properly informed of. Furthermore, Niris’ products are listed without the prejudice of stock availability, which the CUSTOMER will be properly informed of.

8. Non-acceptance right
Although Niris has made any possible effort to display the product characteristics and prices in an accurate way, Niris has the right to decline an order where the products bear incorrect characteristics or price, for example due to typographical error, technical functionality errors or for any other reason.
Niris has the same right in case of an order with a very high cost, and has the right to contact the CUSTOMER.
Niris declares that it has the right to contact the CUSTOMER in order to ensure that the order is carried out smoothly. Furthermore, Niris has the right to contact a person at its judgment, specifically in case the person in question has repeatedly not received the ordered products without any reason.

9. Payment methods
a. Payment via credit/debit card : The CUSTOMER can opt to pay by a credit, debit or prepaid card. The process is carried out through Eurobank website/platform in a completely secure and controlled environment provided by the bank, in order to ensure the confidentiality of the order details (bank information) while they are transmitted online.
It is noted that Niris does not store nor can access the CUSTOMER’s card information entered during the payment as described above.
All payments made using the card are processed through the electronic payment platform of “Eurobank e-Commerce” of Eurobank uses TLS 1.2 encryption protocol encryption with 128-bit (Secure Sockets Layer – SSL). Encryption is a way of coding the information until it reaches its recipient, who will be able to decode it using the appropriate key.
b.Paypal : Pay via your PayPal or you can pay with your credit card if you don’t have a PayPal account. PayPal’s website is secure and encrypted.
c. Bank transfer : You can deposit the amount of the order to the following Niris account.
Your name and the order number need to be indicated as a justification in the respective field of the bank transfer.

10. Shipment and Delivery
A. Delivery time
Niris will deliver the products to the CUSTOMER at the address indicated through a courier or parcel operator, no later than 14 business days after receiving the second confirmation email. Please note that we will do our best to get your order to you as quickly as possible. If you have any questions about your order, please contact us at [email protected]
B. Shipping cost.
For each and any order, the CUSTOMER will be informed by Niris about the shipping costs in a clear way, prior to completing the order. Free shipping applies to all domestic orders. Niris does not take responsibility for orders shipped to incorrect address, or any other address that is different than the one stated into the order. For orders outside the EU, the customer may be subject to additional taxes or customs fees. We recommend consulting the local tax office before making a purchase, as NIRIS Luxury Wear is not responsible for any extra charges incurred.
C. Shipping cost.
For all orders, domestic and foreign,, the CUSTOMER will be informed by Niris about the shipping costs in a clear way prior to completing the order.

12. Orders record
Niris keeps an electronic record of each order. The CUSTOMER can access their own Order on NIRIS website, according to the Company’s Privacy Policy.

13. CUSTOMER rights
13.1 Changing an order before being dispatched
A customer has the right and the possibility to make any order changes, as long as the status or the order is any other than “being dispatched”. In case of any problem with the order change, please contact [email protected].
13.2 Return and refund policy
It is expressly agreed that the CUSTOMER has the right to request a product return or exchange, and is eligible for a full refund of the amount, according to the relevant sales provisions of articles 534 of the Civil Code and provisions referring to faulty products or lack of indicated characteristics. The time frame for executing the full refund rights must not exceed 14 days of the delivery date.
The refund will be approved, provided and confirmed by Niris after examination of the returned product. Essential prerequisite to this is that the item/s are returned in their initial condition, unworn and with detached tags.
13.3 Cancellation of order
The cancellation of order is possible only in case when the order has not been shipped/dispatched. The customer has the right to cancel the order entirely and get a full refund, or make an order change. This is done by sending an email request.

14. Save/Print Purchase Terms
To ensure safe transactions, the CUSTOMER can save and/or print the complete Terms of Use.

RETURN TERMS

1. Refund right
The customer has a right to a refund in a case of:
– they are not happy/satisfied with the ordered product;
– the product is faulty;
– the item does not match the description.
In the case the customer is not satisfied with the ordered product, a full refund will be issued upon returning the product, complying with the conditions mentioned in 13.2.

In case of receiving a faulty item, Niris will offer an exchange, free of charge. If the item is out of stock, the customer may choose an alternative product, for which the shipping costs will be covered by Niris. In case there is no change alternative, Niris will issue a full refund.
In case of receiving a defective, incorrect item, or item with missing parts, the customer is eligible for a full refund, which includes both the purchase price and original shipping cost. To initiate the process, the customer should send a photo of the damaged item along with the order details to [email protected]. After that, Niris team will assist in providing the best and fastest resolution.
Please note that returns or refunds will not be accepted for items reported beyond 14 days from the delivery date. If the damage occurred during shipping, a claim should be filed with the carrier. In such cases, Niris will offer a replacement.

2. Time frame to exercise the right of refund of a faulty product
The CUSTOMER has the right to exercise the right of refund of a faulty or return the product within 14 calendar days from the delivery date. The customer is eligible for a full refund, which includes both the purchase price and original shipping cost. Returns or refunds will not be accepted for items reported beyond 14 days from the delivery date.

3. Ways to exercise the right
The CUSTOMER can proceed to the aforementioned cancellation after they have informed Niris within the above time frame by communicating the clear intention to cancel the order at [email protected].

4. CUSTOMER responsibility
The CUSTOMER is responsible for any depreciation in value of the product(s), which results from handling the product in a way that is not necessary in order to determine the nature, characteristics and functionality of the goods, and subsequently prevent reselling the product.

5. CUSTOMER obligations
a. The CUSTOMER has an obligation to return the goods/services without undue delay and within 14 calendar days since the day they communicated to [email protected] their intention to cancel the contract according to the above. The aforementioned time frame is valid provided the CUSTOMER returns the product(s) within 14 calendar days.
b. The products must be returned by the CUSTOMER in the condition they were received, including the packaging. For the refund to be accepted, all special markings (labels) should be intact, while the purchase order should also be returned.
c. In case the refund is to be deposited on the CUSTOMER’s bank account, the CUSTOMER must indicate the bank account number to be credited by sending their details at [email protected].

6. COMPANY obligations
a. Niris will refund all expenditure received by the CUSTOMER without undue delay and within 14 calendar days since the day the CUSTOMER communicated to Niris their intention to cancel the contract. The reimbursement of money will be performed by Niris using the same payment method selected by the CUSTOMER upon the initial transaction. If the CUSTOMER returns one of our products, the shipping and handling charges that were paid on the initial shipment will not be refunded and will be subtracted from the amount returned to you. It will take Niris 3 business days to process the return once we receive the item, and an additional 5-7 business days for the funds to be cleared by the bank.
b. Niris can withhold the reimbursement of the value of the products until the items are returned.
c. In case the returned product shows any damage, the Customer Support department will contact the CUSTOMER.

7. Return cost and method
The CUSTOMER is responsible to cover the shipping costs for the returned products using an express parcel operator of their own choice.

8. Exceptions to refund right
It is expressly agreed that the CUSTOMER does not have the right to cancel the contract in case the product bought no longer bears the necessary protective covers and labels, as well as in case the form/composition of the product has been substantially altered. Furthermore, the refund does not apply on products indicated in the relevant legislation (see above).

9. Return due to incorrect product
In case the product sent is not the one ordered by the CUSTOMER, it can be returned within 14 business days since the day it was delivered to the CUSTOMER, without any additional shipping costs. In this case, the product can be returned only if it is in its original, unused condition and with the whole original packaging intact. To initiate a return, please reach out to Niris at [email protected] and Niris will arrange for a tracked courier to pick up the item from the CUSTOMER. It is required that returned items must be in perfect condition and include the original packaging, otherwise Niris will not be able to offer an exchange or refund. Additionally, the Items must be unworn and have all original tags attached.
Sale items and items on special offers are non-exchangeable and subject to no refund.
A.Change (replace product) request
1. It is expressly agreed that Niris will accept exchange requests only referring to size and/or color of the product, always without the prejudice of stock availability, within a period of 14 days since the product was received.
In this case, the CUSTOMER has to fill in and send the request to exchange the product via email at [email protected] indicating the product codes to be exchanged, as well as the colour, size and/or other characteristics they wish to receive. The CUSTOMER will receive an email outlining if the request has been accepted within 3 days. In this case, the CUSTOMER is responsible to cover the shipping costs of the returned products, which are sent along the payment receipt, while Niris will resend the new product to the CUSTOMER covering the shipping costs via the cooperating express parcel operator.
2. The products must be returned by the CUSTOMER in the condition they were received, including the packaging. For the exchange to be accepted, all special markings (labels) should be intact, while the purchase order should also be returned.
3. Exceptions: It is expressly agreed that the CUSTOMER does not have the right to cancel the contract in case the product bought no longer bears the necessary protective covers and labels, as well as in case the form/composition of the product has been substantially altered.
4. It is expressly agreed that the CUSTOMER who wishes to exchange the products bought via the website with another product(s) for reasons other than the size and/or colour, always without the prejudice of stock availability, has to follow the cancellation process (as described above), return the product according to the provisions of the respective section (CUSTOMER obligations) and proceed to a new order. If the CUSTOMER chooses to exchange a product and the new item is of a lower value, we will refund the difference through your original payment method. However, this policy does not apply during sale periods, where Niris can only offer exchanges. If the customer is not happy and satisfied with the purchase, and does not want to exchange the purchase, Niris will proceed to a full refund.
B.Exchange due to faulty product or due to lack of indicated characteristics of the product
1. It is expressly agreed that the CUSTOMER has the right to request a product exchange or refund of the amount, according to the relevant sales provisions of articles 534 of the Civil Code, according to the relevant provisions referring to faulty products or lack of indicated characteristics, provided this is also confirmed by Niris after examination of the returned product. In this case, the shipping cost of the return, which will be processed through the express parcel operator collaborating with Niris, will be chargeable to Niris.
2. In the case of exchanging faulty products, the products must be returned by the CUSTOMER in the condition they were originaly received, including the packaging. For the exchange to be accepted, all special markings (labels) and tags should be intact, while the purchase order should also be returned.
