The CUSTOMER of the website is requested to read the Terms of Use before browsing the website and to comply with the terms and conditions that govern its use, which are binding to the customer and the customer unconditionally accepts, as these have been defined by Νiris. It is explicitly agreed that Niris does not account for any damage or harm suffered to the CUSTOMER or any third party by not appropriately complying with the Terms of Use of the website by the CUSTOMER.

The CUSTOMER who purchases products from this website promises and accepts that it complies with all legal conditions in order to conclude the contract, and that they are of age.

Niris gives the CUSTOMER of the website the possibility to register, if they wish, as a member (REGISTERED CUSTOMER-MEMBER) providing specific information, in particular, first name, last name, email, password; at the same time, the CUSTOMER will be requested to verify the password.

By creating a registered CUSTOMER-MEMBER account, the CUSTOMER can also, if they wish and accept so, receive informative emails concerning the prices of Niris’ products, new products, offers, newsletters etc.

The CUSTOMER can withdraw their agreement to receive the aforementioned informative emails at any time. Registering to the Niris Newsletter Service is also available to non-members and is completed by entering the CUSTOMER’s email address in the respective field within the website. Further information is provided in section B.

WEBSITE/E-SHOP SERVICES, II. REGISTRATION. d. The COMPANY gives the CUSTOMER the possibility to Buy without Registering/Buy as Guest. This option requires only the necessary information to process the order.

The CUSTOMER can follow the Niris’ pages on Facebook and Instagram (hereinafter “Social Media”) in order to hear about Niris’ news, comment and/or participate in special promotional actions. Any offer via the Niris’ accounts on Social Media as well as the information posted there shall be subject to the present Terms of Use unless otherwise agreed. Niris does not have access to the CUSTOMER’s personal accounts on Social Media neither controls any of the CUSTOMER’s interactions with them, thus bears no responsibility of the CUSTOMER’s actions and/or any omissions by the social media services providers.  Therefore, the CUSTOMER is required to read the respective terms of those social media carefully.

 

Intellectual property

All content on this website, including but not limited to titles and trademarks, is property of Niris and is protected by the relevant provisions of the Greek Law, the European Law and the applied international conventions on intellectual property.  The company reserves the right to initiate civil, administrative and penal legal procedures against every person violating those terms. The website content is provided to the CUSTOMER for personal use only, and under no circumstances should it be used for public or commercial use. No authorisation or permission is provided to the CUSTOMER to use (in full or in part, copy, distribute, transfer, process, store, reproduce, repost, alter or otherwise process in a similar way without Niris’ explicit prior written consent), Niris’ aforementioned data for any purpose. It is agreed that the CUSTOMER will not use Niris’ name or website in any way that could cause any harm or damage to Niris or a third party, whose compensation is solely the CUSTOMER’s responsibility.

Niris has no responsibility towards the CUSTOMER in case it is not available, for any reason, at any time or for any period. Niris points out that the website may exhibit technical errors directly affecting the way content is presented within the website (for example, pictures, prices, text etc.) for reasons outside Niris’ responsibility and is committed to work to restore them as soon as possible. In light of good faith and fair dealing, Niris is not obliged to accept an order and to complete the sale of products, which, due to a typographical or computerized error, indicate an incorrect price on the online shop. In case such an error occurs in some of the ordered products, the order is valid and processed normally for the rest of the products, but is considered incomplete for the faulty ones, unless the products included in the order constitute a whole and the CUSTOMER declares that a partial processing of the order does not serve to meet their needs or interests, in which case Niris is obliged to cancel the whole order.

In case of erroneous delivery of non ordered products, the unconditional receipt or failure to inform Niris and return of the products cannot be considered as consent, acceptance or intention to buy them. In case Niris requests the return of the products and the CUSTOMER delays the return for more than seven (7) calendar days, the refusal constitutes intention to buy the products, the order is considered confirmed and the CUSTOMER has to pay the corresponding value.

Amendments

Niris has the right to modify or delete, add, unilaterally limit a) the present Terms of Use, partially or in whole, b) its Policies, c) the provided Services, d) the technical specifications of the Website, the content of the website in whole or partially (for example, the text, pictures, product descriptions etc.), fully to the discretion of Niris and/or when such a change is required by law, even without prior notification or acceptance by the CUSTOMER, yet always within fair dealing and the limits specified by the law. The CUSTOMER recognises this right to Niris.

Using the website after the aforementioned amendment is considered a consent to the Terms of Use, as these have been amended. Niris is responsible to communicate any changes according to the above via the website, which shall take effect from the date they are posted on the present website. It is hereby clarified that any change on the present Terms of Use does not apply to orders or other transactions and use of services, which have been initiated before the amendment is in effect according to the above and have been accepted by Niris.

The online shop has taken all, technical and other, necessary measures in order to ensure immediate update of the product availability, however, Niris expressly maintains a reservation to the validity of the quantity of the available products on the online shop, considering it is updated within 72 hours by the time it is amended.

 

REGISTRATION

Registering as a Member is not mandatory in order to complete an order in our online shop. The registration process is quick and simple: After adding a product to the cart and continuing to the payment, the system will automatically guide you to sign up as a new Member, if you wish so. As soon as you enter the requested personal information (name, current email address and password) and accept the present Terms of Use and Transactions and Privacy Policy, you will receive an email in the address you indicated. As soon as you confirm receipt and follow the relevant instructions, you become a Member of the website and we will activate your personal account.
